Triple Talaq Bill: When the divorce doesn't takes place, then why criminalise it?, argues Asaduddin Owaisi

Amid a huge opposition, The Muslim Women (Protection of Rights on Marriage) Bill, 2018 - known as Triple Talaq Bill - has been passed in Lok Sabha on Thursday. The Congress and AIADMK walked out of the Lok Sabha.

“Homosexuality, adultery were decriminalised by the SC and this Govt did not react, then why criminalise Triple Talaq, why? Because the Govt wants to use it against us”, says Asaduddin Owaisi. "When the divorce doesn't takes place, then why crimilize it?", he argued. Adv Waris Pathan of the AIMIM party says, "The Bill is against the Muslim women".

"Any law which comes in between us following our religion is un-constitutional." tweeted Abu Asim Azmi, President - Samajwadi Party, Maharastra. "We only follow the rules written in Quran. No other law is valid for us", says Azam Khan

"This bill does not empower Muslim women, it penalises a Muslim man" Sushmita Dev said.

While many others are celebrating "victory" after the bill has been passed on the Lok Sabha.

"The Modi govt's #TripleTalaqBill - burdened by loopholes - defeats it's own purpose of empowering women. We demand the bill be referred to a Select Committee to provide for a just legislation." tweeted Congress.


The proposed law suggests a three-year jail term for the husband who is accused of giving a Triple Talaq.

“To those who say marriage is just a “contract” in Islam…even if you see it as a contract,no contract can be cancelled unilaterally. Either it’s done on equal terms or there are consequences", said Union Minister Smriti Irani, to which Iftikhar Islam responded on twitter by saying, "The clause of "talaq" is already included in the marriage contract. The man can either give 'talaq" or the woman can take Khula. By giving 'talaq' or taking 'khula', the contract is not breached."


However the triple talaq, known as talaq-e-biddat, is nowhere to be found in the Quran and the authentic teachings of the Prophet Muhammad (peace be upon him). Many of the Islamic scholars believes that there will be only one divorce even if a man gives three divorces (triple talaq) in one sitting.

Now the question is, will the Bill be passed in the Rajya Sabha?
